Definition of Corn

Grain that consists of 50 percent or more of whole kernels of shelled dent corn and/or shelled flint corn (Zea mays L.) and not more than 10.0 percent of other grains for which standards have been established under the United States Grain Standards Act.

 Definition of other terms.

(a) Broken Corn. 

All matter that passes readily through a 12/64 round-hole sieve and over a 6/64 round-hole sieve according to procedures prescribed in FGIS instructions.

(b) Broken corn and foreign material. 

All matter that passes readily through a 12/64 round-hole sieve and all matter other than corn that remains in the sieved sample after sieving according to procedures prescribed in FGIS instructions.

(c) Classes of Corn. 

There are three classes for corn: Yellow corn, White corn, and Mixed corn.

(1) Yellow corn. 

Corn that is yellow-kerneled and contains not more than 5.0 percent of corn of other colors. Yellow kernels of corn with a slight tinge of red are considered Yellow corn.

(2) White corn. 

Corn that is white-kerneled and contains not more than 2.0 percent of corn of other colors. White kernels of corn with a slight tinge of light straw or pink color are considered White corn.

(3) Mixed corn. 

Corn that does not meet the color requirements for either of the classes Yellow corn or White corn and includes white-capped Yellow corn. 

(d) Damaged kernels. 

Kernels and pieces of corn kernels that are badly ground-damaged, badly weather-damaged, diseased, frost-damaged, germ-damaged, heat-damaged, insect bored, mold-damaged, sprout-damaged, or otherwise materially damaged.

(e) Foreign material. 

All matter that passes readily through a 6/64 round-hole sieve and all matter other than corn that remains on top of the 12/64 round-hole sieve according to procedures prescribed in FGIS instructions.

(f) Heat-damaged kernels. 

Kernels and pieces of corn kernels that are materially discolored and damaged by heat.

(g) Sieves.

(1) 12/64 round-hole sieve. 

A metal sieve 0.032 inch thick with round perforations 0.1875 (12/64) inch in diameter which are 1/4 inch from center to center. The perforations of each row shall be staggered in relation to the adjacent row.

(2) 6/64 round-hole sieve. 

A metal sieve 0.032 inch thick with round perforations 0.0937 (6/64) inch in diameter which are 5/32 inch from center to center. The perforations of each row shall be staggered in relation to the adjacent row.

(h) Foreign Matter

Foreign Matter is all matter other than maize, glass, stone, coal, dung, or metal.

(i) Pinked Kernels-

Pinked kernels are maize kernels whose endosperm is white or yellow and whose pericarp or part thereof is red or pink in colour.

 Basis of determination.

Each determination of class, damaged kernels, heat-damaged kernels, waxy corn, flint corn, and flint and dent corn is made on the basis of the grain after the removal of the broken corn and foreign material. Other determinations not specifically provided for under the general provisions are made on the basis of the grain as a whole, except the determination of odor is made on either the basis of the grain as a whole or the grain when free from broken corn and foreign material.

What is Broken Maize/Corn? Broken Maize/Corn Definition-

Broken corn is all matter that passes readily through a 12/64-inch (4.76 mm) round-hole sieve and over a 6/64-inch (2.38 mm) round-hole sieve. In addition, Broken corn is all matter that passes readily through a 4.76 mm round hole sieve and all matter other than corn that remains in the sieved sample.

What is a Defective Maize/Corn Kernel? Defective Maize/Corn Kernel Definition-

Defective kernels are all maize kernels and pieces of maize kernels which are shrivelled, obviously immature, frost-damaged, heat-damaged, mouldy or discoloured, have sprouted (including kernels whose growing point in the germ is visibly discoloured), have cavities in the germ or endosperm caused by insects or rodents, are visibly contaminated by smut, soil, smoke or coal-dust, can pass through the 6.35 mm round-hole sieve, is clearly of inferior quality and of subspecies other than Zea mays indentata or Zea Mays indurata.

What are Discoloured Maize/Corn Kernels? Discoloured Maize/Corn Kernels Definition-

Discoloured kernels are all kernels materially discoloured by excessive heat, including that caused by excessive respiration (heat damage) and dried damaged kernels. Kernels may appear darkened, wrinkled, blistered, puffed or swollen, often with discoloured, damaged germs. The seed coat may be peeling or may have peeled off completely, giving kernels a checked appearance.

1. Buyer issues LOI, BCL signed with seal-stamp, via email

2. Seller may use MT 799 to check the POF of Buyer. 

3. Seller issues SCO/FCO via email

4. Buyer issues signed, sealed ICPO with full banking details via email and also via courier

5. Buyer’s Bank issues SBLC using SWIFT MT760 open for full contract period to be received at Seller’s Bank within 3 (three) working days.

6. SBLC (Stand By Letter of Credit) - must be Irrevocable, Transferable, Divisible, Unencumbered

7. The Seller will present the draft contract (mentioning the details of SBLC MT 760) for acceptance by the Buyer via email and courier also. NCND agreement will also be signed and exchanged via email & via courier also, if there are mediators or affiliates involved from buyer’s or seller’s side. 

8. Buyer returns the draft contract by exchanging it by facsimile or Email attachment, duly signed and sealed, within 3 working days, the emailed draft copy will be deemed legal until hard copies exchanged.

9. SWIFT (MT103) / TT for every shipment against the scanned copies of B/L and other shipping documents at the loading port.

Past Performance/Transactions and Proof of Products

A-1 OVERSEAS does not provide history of past transactions/performance, Proof of Past Performance (POP) as this is against the law and contract rules established between seller and buyer, (Non-Circumvention, Non-Disclosure, and Confidentiality Agreement) NCNDA and/or IMFPA (Irrevocable Master Fee Protection Agreement) of ICC - of International Chamber of Commerce.

Many documents are used fraudulently, therefore we cannot disclose the past performance nor provide any copy of SGS inspection, certificates of origin and others.

We and our counterparts, customers, clients had many problems with documents used illegally by companies/brokers who are acting in the international sugar market.

A-1 OVERSEAS does not provide proof of product anytime before contract signature and bank to bank swift with proof of funds.

Therefore for legal and confidential purposes, we do not provide historical data from other buyers, such as invoices for past shipments, Bills of Lading, invoices from shippers, reports from SGS, laboratory tests, Performance Bonds, Proof of Product (POP), contracts, etc., or any sample document that violates the rules of the ICC (International Chamber of Commerce) and can be plagiarized or falsified.

The real Proof of Product will be presented by the Seller’s bank to the Buyer’s bank at the specified time in the Procedures looking at the situation that time.

Please do not insist as we understand any communication that is not bank to bank has no value either for us or for the buyer/customer/client. We respect our clients but simultaneously we also expect them to follow certain rules to make things feasible for the system.
